Terms of Service

Read this first. Amor Mío is a place to meet people. We do not run background checks, verify identities, or vouch for anyone. You are responsible for your own safety, your own decisions, and how you treat others. These Terms contain a binding arbitration clause and class-action waiver (Section 14) and limit our liability (Section 12). If you do not agree, do not use Amor Mío.

1. Who we are and what this covers

Amor Mío is operated by Amor Mío, LLC, a Florida limited liability company ("Amor Mío," "we," "us"). These Terms govern your use of the Amor Mío mobile application, the website at amormio.love, and any related services (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

2. Eligibility

  1. You must be at least 18 years old. By joining, you affirm that you are 18 or older and that the birthdate you enter is true. We may suspend or delete any account we believe belongs to a minor and may retain evidence for law-enforcement purposes.
  2. You must be legally able to enter a binding contract, not be prohibited from using the Service under the laws of your jurisdiction, and not have been previously removed from Amor Mío.
  3. You must not have been convicted of, or pleaded no contest to, a felony or indictable offense, a sex crime, or any crime involving violence, or be required to register as a sex offender anywhere.
  4. Amor Mío is for single humans only. One person, one account.

3. Your account

You are responsible for everything that happens under your account and for keeping your login code private. Tell us at hola@amormio.love immediately if you believe your account has been accessed without permission. We may refuse, suspend, or terminate any account at any time, for any reason or no reason, with or without notice.

4. Your profile and content

  1. Your profile is one photo, one line, and one circle. The photo must be of you, recent, and show your face. No group photos, no photos of other people, no minors in any photo, no nudity or sexually explicit imagery, no logos or contact information.
  2. You keep ownership of what you post. You grant Amor Mío a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, reproduce, and adapt your content solely to operate and improve the Service, for as long as your content is on the Service and for a reasonable period afterward for backups, legal compliance, and safety reviews.
  3. You represent that you have every right needed to post your content and that it does not infringe or violate anyone's rights.
  4. We do not pre-screen content and have no obligation to monitor. We may remove, hide, or refuse any content at any time in our sole judgment.

5. Community rules

Life is too short for nonsense. You agree that you will not:

Kinky Hearts circle. Members who choose this circle are stating an interest in exploring kink with a partner. Choosing it is not consent to anything, from anyone, ever. Every interaction on Amor Mío, in every circle, requires the clear, ongoing, freely given consent of everyone involved. Explicit content remains prohibited in this circle exactly as in every other. Respect and mutual consent, always.

6. Safety

  1. We do not conduct criminal background checks, identity verification, or screening of any kind. Other members may not be who they say they are. Assume nothing.
  2. You alone are responsible for your interactions with other members, online and in person. Meet in public, tell someone where you are, never send money, and trust your instincts. Read our safety guidance in the app.
  3. Use Block and Report. Reporting a member hides them from you permanently and sends the report to us. We review reports, but we cannot promise any particular action or timeline.
  4. If you feel you are in danger, contact local emergency services first.

7. How connections work — silence and letting go

  1. When two members choose each other, a connection opens and you can message. We call the other person your Chosen Heart.
  2. If a connection has no messages for 14 consecutive days, Amor Mío lets it go automatically and tells both members. Either member may bring it back, free, within 24 hours.
  3. After that window closes, either member may purchase Last Bite to reopen the connection once. Last Bite is available for 30 days after a connection is let go and cannot be used a second time on the same connection. If the reopened connection goes silent for 14 days again, it is let go for good.
  4. Either member may end a connection at any time with Let go. We may also end any connection for safety reasons.
  5. Profiles unseen for 30 days are hidden from the Destiny Queue until the member returns. Accounts inactive for 180 days become dormant; accounts inactive for 12 months are deleted along with their data, as described in the Privacy Policy.

8. Free hearts and paid features

  1. Every member receives a daily allowance of free hearts. Paid features include the Chosen Heart monthly subscription, Refill, Spotlight, Rewind, and Last Bite. Prices are shown in the app before purchase and may change.
  2. All purchases are made through Apple's App Store or Google Play and are subject to their terms. All purchases are final and non-refundable except where Apple or Google issue a refund under their own policies or where the law requires.
  3. Subscriptions renew automatically at the then-current price until you cancel through your App Store or Google Play account settings at least 24 hours before the end of the current period. Deleting the app does not cancel a subscription.
  4. Paid features do not guarantee any result, connection, response, or outcome. Unused hearts, Spotlight time, Rewinds, and Last Bites have no cash value, are non-transferable, and are forfeited when your account is terminated or deleted.

9. Termination

You may delete your account at any time from the Me tab. We may suspend or terminate your account, remove content, or restrict features at any time without notice if we believe you have violated these Terms, created risk for others, or for any other reason. No refunds are owed on termination. Sections 4(b), 9, 10, 11, 12, 13, 14, and 16 survive termination.

10. Intellectual property

The Service, including its name, marks, design, text, code, the comet-heart mark, and all content we create, is owned by Amor Mío, LLC or its licensors and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app on a device you own or control, for personal, non-commercial use, in accordance with these Terms. No other rights are granted.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY ABOUT THE CONDUCT, IDENTITY, INTENTIONS, OR COMPATIBILITY OF ANY MEMBER, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICE, AND YOU MEET AND COMMUNICATE WITH OTHER MEMBERS, ENTIRELY AT YOUR OWN RISK. AMOR MÍO IS A HOSTING SERVICE; CONTENT AND CONDUCT ON THE SERVICE ARE THOSE OF ITS MEMBERS AND NOT OF AMOR MÍO.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AMOR MÍO, LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR REPUTATION, OR FOR ANY PERSONAL INJURY, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICE OR FROM THE CONDUCT OF ANY MEMBER OR THIRD PARTY, WHETHER ONLINE OR OFFLINE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS, IN THE AGGREGATE, WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT THE LAW ALLOWS.

13. Indemnification

You agree to defend, indemnify, and hold harmless Amor Mío, LLC and its members, managers, officers, employees, contractors, and agents from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to your content, your use of the Service, your conduct toward any other member or person, or your violation of these Terms or of any law or right of another.

14. Dispute resolution — binding arbitration and class waiver

  1. Informal resolution first. Before starting any formal proceeding, you agree to email hola@amormio.love with your name, the account email, and a description of the dispute, and to try in good faith to resolve it with us for 60 days.
  2. Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this clause. The arbitrator, not a court, decides all questions of scope and enforceability. Arbitration will take place in Hillsborough County, Florida, or by video, at your election. Each side pays its own attorneys' fees unless the arbitrator awards otherwise under applicable law.
  3. Class waiver. YOU AND AMOR MÍO AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
  4. Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or to stop unauthorized use of the Service.
  5. Opt-out. You may opt out of this arbitration agreement by emailing hola@amormio.love from your account email with the subject "Arbitration opt-out" within 30 days of first creating your account. Opting out does not affect any other part of these Terms.
  6. Jury waiver. If for any reason a claim proceeds in court rather than arbitration, YOU AND AMOR MÍO EACH WAIVE ANY RIGHT TO A JURY TRIAL.

15. Governing law and venue

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 14, the state and federal courts located in Hillsborough County, Florida have exclusive jurisdiction, and you consent to personal jurisdiction there.

16. Apple and Google terms

If you downloaded the app from Apple's App Store, the following also apply. These Terms are between you and Amor Mío, LLC only, not Apple. The license is limited, non-transferable, and for use on Apple-branded devices you own or control. Amor Mío, not Apple, is solely responsible for the app, its content, maintenance and support, any warranty, and any product-liability, consumer-protection, intellectual-property, or legal-compliance claim relating to the app; Apple has no obligation to furnish maintenance or support and, to the extent any warranty cannot be disclaimed, Apple's sole obligation is to refund the purchase price. You represent that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you downloaded the app from Google Play, Google's terms of service and the Google Play terms also apply, and Google is not responsible for the app or its content.

17. Changes

We may update these Terms. If a change is material, we will tell you in the app or by email at least 14 days before it takes effect, except where a change is needed immediately for legal or safety reasons. Continuing to use the Service after a change takes effect means you accept it. If you do not, delete your account.

18. General

These Terms and the Privacy Policy are the entire agreement between you and Amor Mío about the Service. If any provision is found unenforceable, the rest remains in effect, except that if the class waiver in Section 14(c) is found unenforceable the entire arbitration section is void. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them to any successor of the Service. Notices to you may be sent to your account email.
